To standardize supervision and management of safe production of metallurgy and non-ferrous metal enterprises, strengthen safety supervision of metal smelting, implement corporate responsibility for safe production, effectively reduce and prevent production safety accidents, protect the safety and health of employees, and promote stable and improved safety production. The State Administration of Safety Supervision issued the "Safety Production Regulations for Metallurgical Enterprises and Nonferrous Metals Enterprises" (Order No. 91 of the State Administration of Safety Supervision , hereinafter referred to as the "Regulations").

Clear regulatory scope

The "Regulations" pointed out that metallurgical enterprises refer to those engaged in ferrous metal smelting and rolling processing industries; non-ferrous metal enterprises refer to those engaged in nonferrous metal smelting and rolling processing industries; metal smelting refers to metallurgical enterprises. Non-ferrous metal companies are engaged in the production of high-temperature molten metal and slag (hereinafter collectively referred to as high-temperature molten metal) that meets the national scale (mass).

The "Regulations" specify that the specific catalogue of ferrous metal smelting and rolling processing industry, non-ferrous metal smelting and rolling processing industry shall be formulated and announced by the State Administration of Work Safety with reference to "National Economic Sector Classification" ( GB/T4754 ). The State Administration of Safety Supervision will promptly revise and improve the “Metal Smelting Catalogue ( 2015 Edition)” to better suit the actual supervision of the metal smelting industry.

Standardize corporate behavior

The "Regulations" require companies to put in place safe production guarantees and fully implement the company's main responsibility for safe production. Mainly reflected in the establishment of the responsibility system for safety production, the establishment of the dual prevention mechanism for safety production risk control and hidden investigation and control, the construction of safety production standardization, the establishment of safety production management organization and staffing, the safety production reporting system, and the construction projects of metal smelting processes Safety facilities "three simultaneous", identification of dangerous and harmful factors, occupational disease prevention, related party safety management, gas safety management, etc. At the same time, the “safety risks” exist in high-temperature molten metal smelting, leaching, extraction, electrolysis, casting, and metal calendering processes. The “Regulations” cover the protection of buildings, cranes, and personnel gathering places and high temperatures. Protection of molten metal, leaching extraction, electrolysis, coal gas operations, hazardous operations, and other aspects of safety technology security requirements.

Strict punishment measures

The "Regulations" require that the departments responsible for metallurgical non-ferrous production safety supervision should strengthen the supervision and inspection of the company's safety production work in accordance with the law, specify the safety production supervision and management entities of each company, and if any hidden dangers are found, they should be handled in a timely manner; If there is a hidden accident, the supervision shall be carried out. The departments responsible for metallurgical non-ferrous production safety supervision shall incorporate the establishment of the dual prevention mechanism for the construction of safe production, safety production risk control, and hidden troubles and inspections into the annual safety supervision and inspection plan, and supervise and urge enterprises to carry out their work in accordance with the plan. The departments responsible for metallurgical non-ferrous production safety supervision shall strengthen the training of supervisors and inspectors in the professional knowledge of metallurgical and nonferrous metal production safety, and improve their administrative law enforcement capabilities. The departments responsible for metallurgical non-ferrous metal production safety supervision and management shall provide necessary personal protective equipment and monitoring and inspection equipment for those who are to be supervised and inspected in certain workplaces such as limited space.

In accordance with the requirements of the "Regulations," supervisors and inspectors who abuse their powers, neglect their duties, and engage in malpractice for personal gains in the supervision and inspection of enterprises shall be given sanctions in accordance with relevant regulations; if a crime is constituted, criminal responsibility shall be investigated according to law. Violates the provisions of the relevant provisions of the regulations, constitute the production safety accidents, and ordered deadline to eliminate or immediately eliminate accident risks, in accordance with the provisions of "People's Republic of China Production Safety Law" and other directly responsible for production and business unit executives and other Persons directly responsible shall be punished accordingly; if the enterprise refuses to implement it, it shall be ordered to suspend production, stop business for rectification, impose a fine of not less than 100,000 yuan but not more than 500,000 yuan, and charge persons directly in charge and other persons directly responsible for more than 20,000 yuan. Ten thousand yuan fine.

"Regulations" since March 1, 2018 into effect. State Administration of Work Safety September 8, 2009 announced the "metallurgical production safety supervision and management regulations" (State Administration of Work Safety Order No. 26) shall be repealed simultaneously.
